1. Introduction

This Manual is prepared in accordance with Section 51 of the Promotion of Access to Information Act, 2 of 2000 (“PAIA”).

PAIA gives effect to the constitutional right of access to information held by public and private bodies, where that information is required for the exercise or protection of any rights.

Serene Scene is a private body and this Manual explains:

  • what information Serene Scene holds,
  • how access to that information may be requested,
  • and how such requests will be processed.

7. Request Procedure for Access to Records

7.1 How to Request Access

A requester must submit a written request to the Information Officer containing:

  • full name and contact details,
  • sufficient detail to identify the record requested,
  • the reason the record is required (if applicable),
  • proof of identity (where personal information is involved).
  • Requests may be submitted via email to the Information Officer.

7.2 Request Forms

The prescribed PAIA request form (Form C) may be requested from the Information Officer or downloaded from the South African Information Regulator’s website.

8. Fees

Serene Scene may charge the following fees as permitted under PAIA:

  • A request fee (where applicable)
  • An access fee to reproduce or prepare records

The requester will be notified of any applicable fees before the request is processed.

9. Grounds for Refusal of Access

Access to records may be refused on grounds permitted by PAIA, including but not limited to:

  • protection of personal information of third parties,
  • protection of commercial or confidential information,
  • protection of Serene Scene’s proprietary or intellectual property rights,
  • legal privilege,
  • requests that are frivolous or vexatious.

10. Protection of Personal Information (POPIA)

Serene Scene processes personal information in accordance with the Protection of Personal Information Act, 4 of 2013.

Personal information is:

  • processed lawfully and transparently,
  • collected for specific and legitimate purposes,
  • safeguarded using reasonable technical and organisational measures.

11. Remedies Available to Requesters

If a request for access to information is denied, the requester may:

  • lodge a complaint with the Information Regulator, or
  • apply to a competent court for relief.
