1. About Serene Scene and Our Role

Serene Scene operates as a curated directory and ticketing platform that connects users with independent wellness facilitators, practitioners, and venues.

Serene Scene does not organise, host, supervise, manage, or deliver any event, retreat, workshop, or experience listed on the platform. All experiences are independently created and delivered by third-party facilitators or venues.

Serene Scene’s role is limited to:

  • curating listings,
  • providing information,
  • facilitating discovery and connection, and
  • enabling ticketing or enquiry where applicable.

Serene Scene is not a healthcare provider, not an event organiser, and not a party to the delivery of any experience.

2. Acceptance of Terms (ECTA & CPA Compliance)

By accessing or using the Serene Scene website, creating an account, browsing listings, or completing a booking, you agree to be bound by these Terms and Conditions.

These Terms are written in plain language as required by the Consumer Protection Act 68 of 2008. Any limitation of liability, assumption of risk, or disclaimer is drawn to your attention in accordance with Section 49 of the CPA.

If you do not agree with these Terms, you must not use the platform.

3. User Eligibility

  • You must be 18 years or older, or have legal guardian consent, to use this platform.
  • You warrant that all information you provide is accurate and complete.
  • You acknowledge that wellness activities may not be suitable for everyone.

4. Nature of Listings and Content

All listings, articles, blogs, interviews, and descriptions on Serene Scene are provided for informational, educational, and experiential purposes only.
Inclusion of a facilitator or venue on Serene Scene:

  • does not constitute certification, accreditation, medical endorsement, or a guarantee of outcomes,
  • does not imply supervision or control by Serene Scene, and
  • does not create an employment, partnership, or agency relationship.

Facilitators and venues are solely responsible for the accuracy of their listings and the lawful delivery of their services.

5. Bookings, Payments & Contract of Sale

5.1 Contractual Relationship

Any booking made through Serene Scene constitutes a direct contract between the attendee and the facilitator or venue.
Serene Scene is not a party to the contract of sale and has no responsibility for:

  • event quality,
  • delivery,
  • cancellations,
  • rescheduling,
  • refunds,
  • safety,
  • outcomes, or
  • participant experience.

5.2 Non-Refundability Through the Platform

All bookings processed through Serene Scene are non-refundable through the platform.

Once payment is completed, Serene Scene’s service of connection and ticket facilitation is deemed fully performed.

Attendees may contact facilitators directly to request credits or rescheduling at the facilitator’s discretion. Any such arrangement is a private agreement between attendee and facilitator.

5.3 Chargebacks

By completing a booking, you acknowledge and agree that:

  • you waive the right to initiate a chargeback against Serene Scene for event-related issues,
  • any dispute relating to the experience must be resolved directly with the facilitator.

This does not limit statutory rights where applicable under South African law.

6. Health, Wellness & Medical Disclaimer

Serene Scene is not a medical or healthcare provider.

Nothing on this platform constitutes medical, psychological, therapeutic, or professional advice, diagnosis, or treatment.

Wellness practices may include physical, emotional, psychological, or spiritual experiences. Participation is entirely voluntary.

You acknowledge and agree that:

  • you are responsible for assessing your own suitability,
  • you should consult a qualified healthcare professional where appropriate,
  • you must disclose relevant health information to the facilitator directly.

Serene Scene makes no guarantees regarding outcomes, healing, or results.

7. Assumption of Risk & Limitation of Liability

Participation in wellness experiences involves inherent risks.

By using Serene Scene and booking an experience, you voluntarily assume all risks, including physical, emotional, psychological, and spiritual risks.

To the fullest extent permitted by law:

  • Serene Scene shall not be liable for any injury, loss, distress, damage, or death arising from participation in listed experiences.
  • Serene Scene shall not be liable for indirect, incidental, or consequential damages.

Nothing in these Terms excludes liability for gross negligence, fraud, or wilful misconduct by Serene Scene, as required under the Consumer Protection Act.

8. Facilitator & Venue Responsibilities

Facilitators and venues warrant that they:

  • operate lawfully,
  • hold appropriate insurance,
  • obtain informed consent from participants,
  • comply with health and safety regulations,
  • are responsible for participant wellbeing during their offerings.

Serene Scene does not supervise or control how offerings are delivered.

9. Data Privacy & POPIA Compliance

Serene Scene processes personal information in accordance with the Protection of Personal Information Act 4 of 2013.

9.1 Information We Collect

  • Contact details
  • Account information
  • Booking data
  • Communication records
  • Technical data (IP address, device, browser)

9.2 Purpose of Processing

  • Facilitating bookings and connections
  • Communicating platform updates
  • Legal compliance
  • Security and fraud prevention

9.3 Consent & Audit Trails

We use clickwrap consent to record:

  • date and time of consent,
  • document version,
  • IP address,
  • device information.

These records are retained for legal and regulatory compliance.

Serene Scene is committed to protecting your personal information in accordance with the Protection of Personal Information Act (POPIA).

  • Information Collected: We collect identity data, contact data, and transaction data. We may process “Special Personal Information” (e.g., dietary requirements or health conditions) only when voluntarily provided by you to facilitate a safe experience.
    Purpose of Processing: Data is used to facilitate bookings, process payments via secure third-party gateways, and improve our curated offerings.
  • Data Sharing: Your details will be shared with the specific Facilitator of the event you have booked. We do not sell your data to third parties.
  • Your Rights: You have the right to access, correct, or request the deletion of your personal information at any time by contacting our Information Officer.

9.4 Special Personal Information

Health-related information is processed only where necessary and with explicit consent.

10. Vetting & Curation Disclaimer

Serene Scene curates listings for alignment with wellness experiences. This curation:

  • is administrative in nature,
  • does not constitute professional certification,
  • does not guarantee safety or outcomes.

Users remain responsible for conducting their own due diligence.

11. Dispute Resolution & Governing Law

Any dispute arising from use of the platform shall:

  1. first be addressed through written notice,
  2. then mediation where appropriate,
  3. failing which, be subject to the laws of South Africa.

South African courts shall have jurisdiction.

12. Changes to Terms

Serene Scene reserves the right to update these Terms. Continued use of the platform constitutes acceptance of updated Terms.
